One of the main reasons for this is the four elements which are included in its definition, which are as follows, â€Å"the medical professional had a DUTY OF CARE owed to the plaintiff†, â€Å"the medical professional BREACHED that DUTY OF CARE†, â€Å"the breach was both the ACTUAL and PROXIMATE CAUSE of the injury†, and â€Å"the injury resulted in DAMAGES to the plaintiff† (Negligence, 2009).
